Agreement to Terms

By downloading, installing, or using LerneQ ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Description of Service

LerneQ is a mobile application that provides German language learning services, including vocabulary flashcards, spaced repetition learning, and progress tracking.

Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you are at least 13 years old and have the legal capacity to enter into these Terms.

Account Registration

• You may be required to create an account to access certain features.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must immediately notify us of any unauthorized use of your account.

Subscription Terms

Free and Premium Access

• Free Access: The App provides limited free access to certain topics and features.
• Premium Subscription: Premium subscriptions provide access to all topics and features.

Subscription Plans

• Monthly Subscription: Billed monthly, automatically renews unless cancelled.
• Annual Subscription: Billed annually, automatically renews unless cancelled.
• Free Trial: New subscribers may be eligible for a free trial period (typically 7 days).

Billing and Renewal

• Subscriptions automatically renew at the end of each billing period.
• You will be charged the subscription fee to your App Store account.
• You can manage or cancel your subscription through your App Store account settings.
• Cancellation takes effect at the end of the current billing period.

Refund Policy

• Free Trial: You can cancel during the free trial without being charged.
• Paid Subscriptions: Refunds are handled by Apple according to App Store policies.
• Refund Requests: Contact Apple Support for refund requests. We do not process refunds directly.
• No Refunds for Partial Periods: We do not provide refunds for unused portions of subscription periods.

User Responsibilities

You agree to:

• Use the App only for lawful purposes.
• Not attempt to reverse engineer, decompile, or hack the App.
• Not use the App to transmit viruses, malware, or harmful code.
• Not share your account credentials with others.
• Not use automated systems to access the App.
• Respect intellectual property rights.

Intellectual Property

• The App, including all content, features, and functionality, is owned by LerneQ and protected by copyright, trademark, and other laws.
• You may not copy, modify, distribute, or create derivative works of the App without permission.
• All trademarks, logos, and brand names are the property of their respective owners.

User Content

• You retain ownership of any content you create or submit through the App.
• By using the App, you grant us a license to use, store, and process your content to provide services.
• You are responsible for ensuring you have the right to submit any content.

Prohibited Uses

You may not:

• Use the App in violation of any applicable laws.
• Infringe on intellectual property rights.
• Harass, abuse, or harm other users.
• Interfere with or disrupt the App's operation.
• Use the App for commercial purposes without authorization.

Termination

• We may terminate or suspend your access to the App at any time, with or without cause.
• You may stop using the App at any time by deleting it from your device.
• Upon termination, your right to use the App ceases immediately.
• Provisions that by their nature should survive termination will survive.

Disclaimers

• No Warranty: The App is provided "as is" and "as available" without warranties of any kind.
• Learning Outcomes: We do not guarantee specific learning outcomes or results.
• Availability: We do not guarantee uninterrupted or error-free operation of the App.
• Third-Party Services: We are not responsible for third-party services (App Store, RevenueCat, Firebase).

Limitation of Liability

To the maximum extent permitted by law:

• We shall not be liable for any indirect, incidental, special, or consequential damages.
• Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.
• Some jurisdictions do not allow limitations of liability, so some of these limitations may not apply to you.

Indemnification

You agree to indemnify and hold harmless LerneQ, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

Dispute Resolution

• Governing Law: These Terms are governed by the laws of the jurisdiction where LerneQ operates.
• Arbitration: Any disputes shall be resolved through binding arbitration, except where prohibited by law.
• Class Action Waiver: You waive any right to participate in class action lawsuits.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms in the App
• Updating the "Last Updated" date
• Sending a notification (if you have opted in)

Your continued use of the App after changes constitutes acceptance of the new Terms.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and LerneQ regarding the App.

Apple-Specific Terms

If you downloaded the App from the Apple App Store:

• These Terms are between you and LerneQ, not Apple.
• Apple is not responsible for the App or its content.
• Apple has no obligation to provide support for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if applicable).
• Apple is not responsible for addressing any claims related to the App.
